Terms of Sale
(Applicable to ICF Events and any Affiliated Promoter)
1. Introduction
ICF Presents Pty Ltd and its related entities, associated brands, and affiliated promoters (collectively referred to as ICF Events, we, us, our) operate and promote live events at the Ice Cream Factory and other locations.
By purchasing a ticket to an ICF Event, You agree to be bound by these Terms of Sale, which apply to the sale, use, and validity of all tickets, and to your attendance at the event to which your ticket relates (Event). These Terms apply to the purchaser and any subsequent ticketholder (You or Your).
In addition to these Terms of Sale, Your attendance may be subject to:

- Event-Specific Terms for the applicable Event
- ICF Events Terms of Sale (this document)
- Authorised Ticketing Agency Terms & Conditions
If any inconsistency arises, the above order of enforceability will apply.
ICF Events reserves the right to cancel any ticket used in breach of these Terms or any other applicable conditions.
2. Purchase of Tickets
Tickets for ICF Events are available exclusively through Authorised Ticketing Agencies.
You are strictly warned not to purchase tickets from unauthorised sellers or resale platforms.
ICF Events does not allocate tickets to unauthorised resellers, including but not limited to:
Viagogo, Stubhub, Facebook Marketplace, Gumtree, eBay, or Buy/Sell/Swap groups.
Purchasing via unauthorised channels is entirely at your own risk.
ICF Events and the Authorised Ticketing Agency will not assist with, validate, or replace invalid or fraudulent tickets.
Dynamic Pricing: The price of a ticket may increase or decrease at any time based on demand or promotional periods. You are only entitled to the price displayed at the time of Your transaction and are not entitled to a refund or credit for any subsequent price changes.
Fraud Prevention: We reserve the right to refuse or cancel any order if we suspect fraudulent activity. This includes stolen cards, unusual purchasing patterns, or mismatched billing information. ICF Events is not liable for any losses resulting from failed 3DS verification or other fraud prevention measures.
3. Use of Tickets
Tickets must not be:
- Resold at a price exceeding the original price (unless permitted by law).
- Used for advertising, promotions, sponsorship, competitions, or giveaways without ICF Events’ prior written approval.
ICF Events reserves the right to immediately cancel, without refund or notice, any ticket used in breach of this clause.
4. Event Specific Terms
Certain Events may require additional conditions (Event Specific Terms), including but not limited to entry requirements, on-site behaviour rules, licensing restrictions, or prohibited items.
These will be published on the ICF Events website and/or the Authorised Ticketing Agency website and are incorporated into these Terms.
5. Event Changes
ICF Events reserves the right to:
- Add, withdraw, or substitute artists
- Change or vary the program
- Adjust times, dates, locations, or audience capacity
- Modify stage layout or venue configuration
- Update pricing or ticket classifications. All published times (including door times, set times, and conclusion times) are indicative only and subject to change without notice. ICF Events does not guarantee specific event durations or finish times. No entitlement to a refund or compensation arises from variations in start, performance, or conclusion times.
For multi-artist or festival-style events, line-up changes may occur without notice.
6. Reduced Capacity or Varied Configuration Due to Intervening Circumstances
If Intervening Circumstances require the Event capacity to be reduced or reconfigured, ICF Events may cancel transactions at its discretion.
If Your transaction is cancelled, You will receive a full refund of the ticket price.
Intervening Circumstances include, but are not limited to:
- Acts of God
- Extreme weather
- Natural disasters
- Public health emergencies
- Pandemics
- Government or health directives
- Venue closures
- Travel restrictions
or any circumstance beyond our control.
7. Ticket Purchase Limits
ICF Events may impose ticket limits per purchaser to ensure fair access.
If You exceed published limits, any or all of Your tickets may be cancelled without notice.
This includes purchases linked by:
name, email, IP address, billing address, credit card, account details, or similar identifiers.
8. Cancelled, Rescheduled or Significantly Relocated Events
ICF Events will comply with the Australian Consumer Law and other applicable codes.
8.1 Cancelled Event
If an Event is cancelled, You are entitled to a full refund of the ticket price.
8.2 Rescheduled Event
If an Event is rescheduled, Your ticket will remain valid unless otherwise advised.
If You cannot attend the new date, You may apply for a refund within the advertised timeframe.
8.3 Significantly Relocated Event
If an Event is moved to a significantly different venue, Your ticket remains valid.
If You cannot attend the relocated Event, You may request a refund within the notified timeframe.
For the avoidance of doubt, a “Significant Relocation” refers to a change in the suburb or geographical region of the Event; a change of stage, tent, room, or specific activation area within the same venue precinct (e.g., moving from ICF: Outdoor to ICF: Warehouse) does not constitute a Significant Relocation and does not entitle You to a refund.
Refunds are limited to the ticket price only and exclude booking fees or ancillary costs unless required by law.
9. Show Expectations, Experience & Non-Refundable Conditions
ICF Events take reasonable steps to deliver a safe and enjoyable entertainment experience. However, You acknowledge and accept that:
- Live music, entertainment and performances are subjective experiences
- Artist set times, running order, production levels, visual effects, sound quality and performance content may vary
- Crowd behaviour and general atmosphere may differ between nights or sessions
- The Venue environment may change throughout the Event, including noise levels, temperature, capacity, crowd density or layout
- Patron interactions with Event personnel (including security, bar staff, management or service providers) may be necessary for safety, compliance and operational reasons
Accordingly, no entitlement to a full or partial refund, exchange, compensation or any other remedy arises where Your enjoyment or perception of the Event is affected by:
- Artist performance style, duration, repertoire, lateness or cancellation of individual performers within a multi-artist Event
- Production or staging variations, lighting, sound, or special effects
- Venue layout, sightlines, crowd density, environmental conditions or queuing
- Interactions with security, staff or other patrons (including refusal of service or directions given under licensing or safety requirements)
- Your subjective satisfaction, level of enjoyment, or personal expectations of the Event experience
Refunds, where applicable, will only be provided in accordance with the Australian Consumer Law, the Applicable Codes, or as otherwise expressly stated in these Terms of Sale.
9.1 Primary Purpose of Contract
You acknowledge and agree that the primary and dominant purpose of Your ticket purchase is to attend a live performance by the advertised Headline Artist(s). Provided that the Headline Artist is present at the Venue and performs a set of a duration consistent with industry standards for their current tour, ICF Events has fulfilled its primary contractual obligation to You. The Event is deemed to have concluded at the completion of the Headline Artist’s performance. Any continued access to the Venue, bar services, or ancillary activations thereafter (such as Silent Discos or specialty bars) is at the sole discretion of Event management and does not form part of the Ticket price. A variation, absence, or dissatisfaction with these secondary features does not constitute a major failure of the contract and does not entitle You to a refund
10. ICF Events Liability
ICF Events is not liable for any additional costs incurred due to cancellations, rescheduling, or changes to an Event (such as travel, meals, parking, accommodation, or third-party purchases), except where required under the Australian Consumer Law.
11. Refund or Replacement Tickets
Refunds or replacement tickets will only be provided in accordance with these Terms or as required under the Australian Consumer Law.
General Admission tickets will not be replaced if lost, stolen, damaged, or destroyed.
Authorised Ticketing Agencies may charge fees for replacement or reissue where permitted.
12. Mistakes or System Errors
Customer Responsibility: You are responsible for confirming all Event details before purchasing. No refunds for wrong date, wrong event, or mistaken duplicate purchases.
Errors: We reserve the right to cancel any order or rectify any information resulting from a system error, pricing error, or administrative typo. ICF Events is not bound by discrepancies in third-party listings or clerical errors in marketing materials (including social media posts) regarding event timings. In the event of an inconsistency between marketing content and the Venue’s operational requirements or licensing curfews, the Venue’s requirements will prevail without entitlement to a refund.
Administrative Costs: If a customer error results in a need to reprocess a transaction, we may charge the actual costs incurred, including third-party bank fees or administrative charges.
Refunds will not be granted for errors including:
- Wrong date
- Wrong Event
- Wrong ticket type or payment method
- Mistaken duplicate purchases
13. Event Age Restrictions
All patrons must have a valid ticket to enter.
Events may be:
- 18+ only,
- or age-restricted in accordance with licensing and safety requirements.
Any age restrictions will be published on the Event page and/or the ticketing website.
Valid ID must be presented upon entry when required.
14. VIP / Add-On Packages
From time to time, ICF Events may offer hospitality, VIP, or upgrade packages (Event Packages). Additional terms may apply.
ICF Events is responsible only for Event Packages sold directly by ICF Events or its Authorised Ticketing Agencies.
Packages sold by third parties fall under the responsibility of the respective operator.
15. Photography & Filming
By attending the Event, You and each attendee in Your group agree that You may be filmed and/or recorded. You grant permission to ICF Events and its partners to use Your image, likeness, and voice in all media throughout the world for any purpose (promotional or archival) without compensation. Unauthorised professional photography or video recording is prohibited.
Unauthorised professional photography, audio, or video recording is strictly prohibited.
Event personnel may delete or confiscate unauthorised recordings.
16. Event Entry, Security, Safety & Conditions of Entry
Entry to all ICF Events is subject to strict compliance with these Conditions of Entry, applicable Venue requirements, licensing laws, and directions issued by Event personnel, security contractors, police, or Government authorities. By attending the Event You agree to the following:
16.1 Age Restrictions & Identification
ICF Events at the Ice Cream Factory are strictly 18+ only, unless expressly stated otherwise within the guidelines outlined by ICF.
All patrons must produce valid, acceptable identification on request. The following forms of ID will be accepted:
- Current Australian Drivers Licence with photograph
- Current Passport with photograph
- Current Western Australian Proof of Age Card
Expired, damaged, photocopied, digital, or otherwise invalid ID will not be accepted.
If You are unable to present valid identification, You will be refused entry without refund.
16.2 NO Pass-Outs / NO Re-Entry
ICF Events operate under a strict no pass-out policy.
Once a patron exits the Venue — whether voluntary or due to refusal or removal — re-entry will not be permitted under any circumstances.
No refund, credit, exchange, or compensation will apply to any patron who leaves or is removed from the Venue.
16.3 Alcohol, Licensing & Intoxication
ICF Events are held within licensed premises. As a condition of entry and continued attendance, You agree that:
- No external alcoholic beverages may be brought onto the venue, if you attempt to bring in alcohol or illicit substances and it is to be found in your possession at the point of entry these items will be confiscated and you will be denied entry into the venue/event
- All personal medication must be accompanied by a valid prescription or pharmacy-issued packaging clearly displaying the patron’s full name and dosage details. Medication without appropriate labelling, packaging or proof of prescription may be confiscated or refused entry.
- Alcohol purchased inside the Venue must not be removed
- Intoxicated or disorderly patrons will be refused service, refused entry, or removed without refund
- It is an offence to purchase or supply alcohol to minors or intoxicated persons
- ICF Events may require patrons to cease alcohol consumption at any time
Misuse of alcohol or unsafe consumption will not be tolerated.
16.4 Patron Behaviour & Ejection
ICF Events prioritise the safety and enjoyment of all attendees. Entry may be refused or a patron may be ejected (with no entitlement to refund) where behaviour is:
- Violent, aggressive, threatening or abusive
- Disorderly, unsafe or disruptive
- Drug-affected or suspected to be drug-affected
- In possession of illegal drugs or paraphernalia
- In breach of Event policies, Venue rules or security directives
Police involvement may occur in serious or unlawful situations.
16.5 Dress Requirements & Prohibited Identification
Appropriate attire, including footwear, must be worn at all times.
Entry will be refused to patrons wearing, displaying or possessing:
- Clothing, symbols, insignia or patches of Outlaw Motorcycle Gangs (OMCGs)
- Any visible identifier of groups banned or restricted pursuant to law enforcement directives
The decision of Event or security personnel regarding dress suitability is final.
16.6 Ticketing Validation & Site Access
ICF Events reserve the right to:
- Verify the validity of tickets and refuse entry for fraudulent or cancelled tickets
- Deny entry where tickets are defaced, duplicated, or cannot be authenticated
- Restrict patron movement within the Venue for safety and operational requirements
Patrons are responsible for their personal belongings.
ICF Events accepts no liability for lost, stolen or damaged items.
16.7 Photography & Recordings CCTV
All ICF Event sites operate CCTV for security monitoring.
By entering the Venue, You consent to:
- Being filmed, photographed, or recorded
- Event organisers capturing and using such content for safety, promotional, marketing, or archival purposes
- Use without compensation or restriction
Unauthorised professional photography, filming, or recording equipment may be confiscated or deleted.
16.8 Compliance With Directions
Patrons must follow instructions issued by Event staff, security personnel, first aid teams and emergency services.
Failure to comply with instructions, conditions, signage or lawful orders may result in refusal of entry or ejection without refund.
17. Loss or Injury at Event
To the fullest extent permitted by law, You release ICF Events (and its directors, staff, contractors, security, and volunteers) from liability for any injury, loss, damage, or claim arising from Your attendance.
You agree to compensate ICF Events for any loss or damage caused by Your negligent, intentional, or reckless behaviour.
18. Risk
Attendance at an Event involves inherent risks, including but not limited to:
crowds, noise, lighting effects, weather conditions, alcohol service, and communicable diseases.
You acknowledge and agree:
- You attend at Your own risk
- You must wear appropriate footwear and clothing
- Dangerous crowd behaviour (moshing, crowd surfing, stage-diving, etc.) is prohibited
- Prolonged noise exposure can cause hearing damage
- You may be exposed to COVID-19 or other communicable illnesses
ICF Events may impose health or safety requirements as mandated by health authorities or licensing bodies.
Failure to comply may result in refusal of entry or removal from the Event.
19. Personal Information
Your personal information may be collected by ICF Events and/or the Authorised Ticketing Agency for the purposes of administering ticket sales, facilitating Event entry, or communicating Event information.
Your information may be disclosed as required by law, and otherwise handled in accordance with our Privacy Policy.
20. Prohibited Items
Prohibited items may vary per Event or Venue but may include:
- Alcohol
- Illicit substances
- Weapons, projectiles, or dangerous items
- Professional recording equipment
- Glass, metal containers, hard plastic
- Food or beverages
- Umbrellas
- Chairs or camping equipment
- Drones
- Fireworks or flammable items
- Large bags or items that block views
- Flags, poles, banners
- Animals (except certified assistance animals)
- Any item deemed unsafe by Event personnel
Any prohibited item must be surrendered and will not be returned.
21. Variation of Terms
ICF Events may amend these Terms of Sale at any time.
Changes take effect immediately once published on the ICF Events website and will not apply retrospectively.
22. Enforceability
If any clause is deemed invalid or unenforceable, the remainder of these Terms will continue in full force.
