Applicable to ICF Events and any Affiliated Promoter  ·  Bar Pop Event Management 2026

1. Introduction

ICF Presents Pty Ltd and its related entities, associated brands, and affiliated promoters (collectively referred to as ICF Events, we, us, our) operate and promote live events at the Ice Cream Factory and other locations.

By purchasing a ticket to an ICF Event, you agree to be bound by these Terms of Sale, which apply to the sale, use, and validity of all tickets, and to your attendance at the event to which your ticket relates. These Terms apply to the purchaser and any subsequent ticketholder.

In addition to these Terms of Sale, your attendance may be subject to Venue Terms & Conditions, Event-Specific Terms, and Authorised Ticketing Agency Terms & Conditions. If any inconsistency arises, the above order of enforceability will apply.

ICF Events reserves the right to cancel any ticket used in breach of these Terms or any other applicable conditions.

2. Purchase of Tickets

Tickets for ICF Events are available exclusively through Authorised Ticketing Agencies. You are strictly warned not to purchase tickets from unauthorised sellers or resale platforms. ICF Events does not allocate tickets to unauthorised resellers, including but not limited to: Viagogo, Stubhub, Facebook Marketplace, Gumtree, or eBay. Purchasing via unauthorised channels is entirely at your own risk.

Dynamic Pricing: The price of a ticket may increase or decrease at any time based on demand or promotional periods. You are only entitled to the price displayed at the time of your transaction.

Fraud Prevention: We reserve the right to refuse or cancel any order if we suspect fraudulent activity, including stolen cards, unusual purchasing patterns, or mismatched billing information.

3. Use of Tickets

Tickets must not be resold at a price exceeding the original price (unless permitted by law), or used for advertising, promotions, sponsorship, competitions, or giveaways without ICF Events' prior written approval.

ICF Events reserves the right to immediately cancel, without refund, any ticket used in breach of this clause.

4. Event Specific Terms

Certain Events may require additional conditions including entry requirements, on-site behaviour rules, licensing restrictions, or prohibited items. These will be published on the ICF Events website and are incorporated into these Terms.

5. Event Changes

ICF Events reserves the right to add, withdraw, or substitute artists, change the program, adjust times, dates, locations, or audience capacity, and modify stage layout or venue configuration. All published times are indicative only and subject to change without notice.

No entitlement to a refund or compensation arises from variations in start, performance, or conclusion times. For multi-artist or festival-style events, line-up changes may occur without notice.

6. Reduced Capacity or Varied Configuration

If Intervening Circumstances require the Event capacity to be reduced or reconfigured, ICF Events may cancel transactions at its discretion. If your transaction is cancelled, you will receive a full refund of the ticket price.

Intervening Circumstances include acts of God, extreme weather, natural disasters, public health emergencies, pandemics, government directives, venue closures, travel restrictions, or any circumstance beyond our control.

7. Ticket Purchase Limits

ICF Events may impose ticket limits per purchaser to ensure fair access. If you exceed published limits, any or all of your tickets may be cancelled without notice. This includes purchases linked by name, email, IP address, billing address, credit card, or account details.

8. Cancelled, Rescheduled or Relocated Events

ICF Events will comply with the Australian Consumer Law and other applicable codes.

8.1 Cancelled Event

If an Event is cancelled, you are entitled to a full refund of the ticket price.

8.2 Rescheduled Event

If an Event is rescheduled, your ticket will remain valid unless otherwise advised. If you cannot attend the new date, you may apply for a refund within the advertised timeframe.

8.3 Significantly Relocated Event

If an Event is moved to a significantly different venue, your ticket remains valid. If you cannot attend the relocated Event, you may request a refund within the notified timeframe. A change of stage, tent, room, or activation area within the same venue precinct does not constitute a Significant Relocation and does not entitle you to a refund.

Refunds are limited to the ticket price only and exclude booking fees or ancillary costs unless required by law.

9. Show Expectations & Non-Refundable Conditions

ICF Events take reasonable steps to deliver a safe and enjoyable entertainment experience. However, you acknowledge that live music and performances are subjective experiences. No entitlement to a refund, exchange, or compensation arises where your enjoyment is affected by:

  • Artist performance style, duration, repertoire, or lateness
  • Production or staging variations, lighting, sound, or special effects
  • Venue layout, sightlines, crowd density, or environmental conditions
  • Interactions with security, staff or other patrons
  • Your subjective satisfaction or personal expectations
9.1 Primary Purpose of Contract

The primary purpose of your ticket purchase is to attend a live performance by the advertised Headline Artist(s). Provided that the Headline Artist performs a set consistent with industry standards, ICF Events has fulfilled its primary contractual obligation. Any continued access to bar services or ancillary activations after the headline performance is at the sole discretion of Event management and does not form part of the ticket price.

10. ICF Events Liability

ICF Events is not liable for any additional costs incurred due to cancellations, rescheduling, or changes to an Event — such as travel, meals, parking, accommodation, or third-party purchases — except where required under the Australian Consumer Law.

11. Refund or Replacement Tickets

Refunds or replacement tickets will only be provided in accordance with these Terms or as required under the Australian Consumer Law. General Admission tickets will not be replaced if lost, stolen, damaged, or destroyed.

12. Mistakes or System Errors

You are responsible for confirming all Event details before purchasing. No refunds will be granted for wrong date, wrong event, wrong ticket type, or mistaken duplicate purchases.

We reserve the right to cancel any order or rectify information resulting from a system error or pricing error. ICF Events is not bound by discrepancies in third-party listings or clerical errors in marketing materials.

13. Event Age Restrictions

All patrons must have a valid ticket to enter. Events may be 18+ only or age-restricted in accordance with licensing and safety requirements. Valid ID must be presented upon entry when required.

14. VIP / Add-On Packages

From time to time, ICF Events may offer hospitality, VIP, or upgrade packages. Additional terms may apply. ICF Events is responsible only for packages sold directly by ICF Events or its Authorised Ticketing Agencies.

15. Photography & Filming

By attending the Event, you agree that you may be filmed and/or recorded. You grant permission to ICF Events and its partners to use your image, likeness, and voice in all media throughout the world for any purpose without compensation. Unauthorised professional photography, audio, or video recording is strictly prohibited.

16. Entry, Security & Conditions
16.1 Age & ID

ICF Events at the Ice Cream Factory are strictly 18+. Acceptable ID: current Australian Driver's Licence, current Passport, or current WA Proof of Age Card. Expired, damaged, photocopied, or digital ID will not be accepted. If you cannot present valid ID, you will be refused entry without refund.

16.2 No Pass-Outs / No Re-Entry

ICF Events operate a strict no pass-out policy. Once a patron exits the venue — whether voluntary or due to removal — re-entry will not be permitted under any circumstances. No refund or compensation applies.

16.3 Alcohol, Licensing & Intoxication
  • No external alcoholic beverages may be brought onto the venue
  • Personal medication must be accompanied by a valid prescription or pharmacy packaging
  • Alcohol purchased inside must not be removed from the venue
  • Intoxicated or disorderly patrons will be refused service or removed without refund
  • It is an offence to purchase or supply alcohol to minors or intoxicated persons
16.4 Patron Behaviour & Ejection

Entry may be refused or a patron ejected (with no entitlement to refund) where behaviour is violent, aggressive, disorderly, drug-affected, or in breach of Event policies. Police involvement may occur in serious situations.

16.5 Dress Requirements

Appropriate attire including footwear must be worn at all times. Entry will be refused to patrons wearing clothing, symbols, or insignia of Outlaw Motorcycle Gangs (OMCGs) or restricted groups.

16.6 Ticketing Validation

ICF Events reserve the right to verify ticket validity and refuse entry for fraudulent or cancelled tickets. Patrons are responsible for their personal belongings — ICF Events accepts no liability for lost, stolen, or damaged items.

16.7 CCTV

All ICF Event sites operate CCTV for security monitoring. By entering the venue, you consent to being filmed, photographed, or recorded, and to that content being used for safety, promotional, or archival purposes without compensation.

16.8 Compliance With Directions

Patrons must follow instructions issued by Event staff, security, first aid, and emergency services. Failure to comply may result in refusal of entry or ejection without refund.

17. Loss or Injury at Event

To the fullest extent permitted by law, you release ICF Events (and its directors, staff, contractors, security, and volunteers) from liability for any injury, loss, damage, or claim arising from your attendance. You agree to compensate ICF Events for any loss or damage caused by your negligent, intentional, or reckless behaviour.

18. Risk

Attendance at an Event involves inherent risks including crowds, noise, lighting effects, weather conditions, alcohol service, and communicable diseases. Dangerous crowd behaviour — moshing, crowd surfing, stage-diving — is prohibited. Prolonged noise exposure can cause hearing damage.

19. Personal Information

Your personal information may be collected by ICF Events and/or the Authorised Ticketing Agency for the purposes of administering ticket sales, facilitating Event entry, or communicating Event information. Your information may be disclosed as required by law and otherwise handled in accordance with our Privacy Policy.

20. Prohibited Items

Prohibited items may vary per Event but may include:

  • Alcohol or illicit substances
  • Weapons, projectiles, or dangerous items
  • Professional recording equipment
  • Glass, metal containers, or hard plastic
  • Outside food or beverages
  • Umbrellas, chairs, or camping equipment
  • Drones, fireworks, or flammable items
  • Large bags or items that block views
  • Flags, poles, or banners
  • Animals (except certified assistance animals)
  • Any item deemed unsafe by Event personnel

Any prohibited item must be surrendered and will not be returned.

21. Variation of Terms

ICF Events may amend these Terms of Sale at any time. Changes take effect immediately once published on the ICF Events website and will not apply retrospectively.

22. Enforceability

If any clause is deemed invalid or unenforceable, the remainder of these Terms will continue in full force.
